Stakeholder Meetings

Join TABC staff by video conference to discuss draft rules for publication. These rules were drafted to implement several new laws from the regular session of the 89th Texas Legislature.

  • Item 1. New Rule 41.28 to add provisions required by HB 4285.
    • New Section 41.28 requires passenger transport permittees to submit non-airport storage location information to TABC prior to storage, and update TABC within 30 days of any change.
  • Item 2. Revisions to Rule 45.40 and new Rule 45.44 to add provisions required by HB 4463.
    • New Section 45.44(?) clarifies that nonresident brewers must hold a permit before shipping malt beverages into Texas or registering malt beverage products in Texas, but are not required to hold a separate license with TABC for each brewing location outside the state.
    • Amendments to 45.40 establish a process for nonresident brewer permit holders to fulfill and notify TABC of the primary American source of supply.
  • Item 3. Revisions to Rule 34.10 and new Rule 45.132 to add provisions required by SB 1355.
    • New Section 45.132 establishes a process for distiller and rectifier permittees to file complaints with TABC when a wholesaler is reported to be delinquent in payment.
    • Amended Section 34.10 includes new administrative penalties for wholesalers determined to be delinquent.
  • Item 4. Revisions to Rules 33.72, 33.77, and 33.81 to add provisions required by SB 1577.
    • Amendments to Sections 33.72 and 33.77 remove references to “racing events” and make nonsubstantive grammatical changes.
    • Amendments to Section 33.81 adds language allowing mixed beverage permit holders to purchase alcoholic beverages for a temporary event at a qualifying racing facility from the nearest county to the facility if the county where the racing facility is located does not have a local distributor.

It is TABC's intent to propose the attached rules for publication at the commission meeting in September.
